Job Applicant Privacy Notice For California Applicants Only


This Job Applicant Privacy Notice (the “Notice”) describes how Roku, Inc., its subsidiaries, and affiliates (“Roku”“we” or “us”) collect and process the Personal Information of California residents during the recruiting and job application process.

This Notice applies only to our processing of Personal Information about you as a job applicant.  Any information collected outside of this context is governed by our other privacy policies. For example, information collected during your interaction with us as a consumer of Roku branded products and services is governed by the Roku Privacy Policy.

For the purpose of this Notice, “Personal Information” means information that identifies, or could reasonably be associated with, you, your device or household, or as otherwise defined by the California Consumer Privacy Act of 2018 (“CCPA”). Personal Information does not include information that is

  • Publicly available, as defined by the CCPA.
  • Deidentified or aggregated.
  • Otherwise excluded from the scope of the CCPA.
  1. Sources of Personal Information We Collect

We collect Personal Information from you when you provide it to us, or automatically when you access our websites or emails.  We may also obtain information about you from other sources, including former employers, employment agencies, background check service providers, credit reference agencies, other individuals who provide professional or personal references about you, social media networks including LinkedIn, and public registries and directories.

  1. Categories of Personal Information We Collect and Disclose to Third Parties:
    1. Identifiers, including online identifiers, device identifiers, internet protocol addresses, browser cookies, and other unique online identifiers.
    2. Other contact information, including name, address, email address, telephone number.
    3. Characteristics of protected classifications under California or Federal Law, including race, ethnicity, sex, gender, marital status, age, veteran status, national origin, disability, and citizenship status.
    4. Professional/Employment information, including:
      • Information provided in your resume and job application, including education information (degrees, academic records, awards and achievements, etc.) and professional qualifications (licenses, memberships and certifications, etc.), as well as work authorization status, language skills, and any other information that you present us with as part of your application related to fulfilment of the role.
      • Current and previous employment details.
      • Financial information, including current salary, tax status information including national tax payor ID, and Insurance ID numbers.
      • Where necessary, information concerning your health, any disability and in connection with any requested workplace accommodations.
    5. Internet and network activity information, including browsing history, search history, and information regarding your interaction with our websites, our recruiting platform and software, and the emails we send you.
    6. Audio and visual data, including CCTV footage, photographs, audio/video recordings (including recorded interviews, meetings, webinars, and presentations) and records of use of video conferencing tools.
    7. Education Information, including university degree information, academic records, awards, and achievements.
    8. Sensitive Information, including Personal Information that reveals social security number, driver’s license number, state identification card, passport number, national or state ID, racial, ethnic, or national origin, health and well-being, precise geolocation, and the contents of your email where we are not the intended recipient.  
    9. Feedback information, including responses to surveys, questionnaires, and other feedback information.
    10. Other information, including dependent and beneficiary information, emergency contacts, bank account number, and electronic building access records.

    Over the past 12 months, Roku has disclosed for a business purpose each of the categories of Personal Information as described in the Section 2 above to service providers and contractors.

    Over the past 12 months, Roku has not disclosed any of the above categories of data of applicants in a manner that would constitute a sale of data or sharing for cross-context behavioral advertising under CCPA.  Roku does not have actual knowledge that it sells Personal Information or shares for cross-context behavioral advertising the Personal Information of consumers under sixteen (16) years of age.  Roku does not use or disclose Sensitive Personal Information for purposes other than those set forth in the CCPA.

    1. Purposes of Processing Personal Information

    We collect, use, or disclose your Personal Information for the purposes outlined in this Notice, including the business purposes below:

    • To recruit and onboard you.
    • To track your application to work for Roku.
    • To contact you or others on your behalf.
    • To track use of our websites, interaction with emails we send you, and your application status.
    • To enter into, perform, maintain, and change your employment contract with Roku.
    • To support workplace diversity, equity, inclusion and fair employment practices.
    • To protect the rights and property of Roku, our users, applicants, employees or the public.
    • To measure performance and analyze key metrics relevant to our business.
    • To communicate with you, including sending you notices, updates, security alerts, surveys, and support and administrative messages; and to respond to your comments and questions.
    • To enforce our terms and conditions or protect our business, partners or users, and comply with our contractual and legal obligations.
    • To protect, investigate, and deter against fraudulent, unauthorized, infringing or illegal activity.
    1. Retention

    Roku retains your Personal Information only for as long as necessary to fulfill the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements.

    To determine the appropriate retention period for Personal Information, Roku considers the:

    • amount, nature, and sensitivity of the Personal Information;
    • potential risk of harm from unauthorized use or disclosure of your Personal Information;
    • purposes for which Roku processes your Personal Information and whether Roku can achieve those purposes through other means; and
    • applicable legal requirements.
    1. Your California Privacy Rights

    If you are a California resident, you may exercise the following rights:

    • The right to know what Personal Information we have collected about you, including the categories of Personal Information, the categories of sources from which the Personal Information is collected, the business or commercial purpose for collecting, selling, or sharing Personal Information, the categories of third parties to whom we disclose Personal Information, the specific pieces of Personal Information we have collected about you, the categories of Personal Information that the business sold or shared, and for each category identified, the categories of third parties to whom it sold or shared that particular category of Personal Information, and the categories of Personal Information that the business disclosed for a business purpose, and for each category identified, the categories of service providers or contractors to whom it disclosed that particular category of Personal Information.
    • The right to correct inaccurate Personal Information that we maintain about you.
    • The right to request deletion of the Personal Information that we have collected about you, subject to certain exemptions.
    • The right not to be retaliated against for the exercise of your CCPA privacy rights, subject to certain exceptions.

    You can submit a request to know, correct, and delete your Personal Information by emailing workforceprivacy@roku.com. Such requests are subject to our ability to reasonably verify your identity. Upon making a request, we may need to verify your identity by asking you to provide additional information to allow us to identify you.

    You may authorize another person (your “authorized agent”) to submit a request on your behalf through the methods described above. Your authorized agent should submit proof that you gave the agent signed permission to submit the request. We may still require you to directly verify your identity and directly confirm that you have provided the authorized agent permission to submit the request.

    Please note, by submitting your request in the manner described in this Notice, your request will only affect the Personal Information that we hold about you as an applicant. Any information collected outside of this context is governed by our other privacy policies. For example, information collected during your interaction with us as a consumer of our products and services is governed by the Roku Privacy Policy.

    1. Modifications

    We may amend this Notice at any time by posting the amended version on the Roku Jobs site or by providing such notice about or obtaining consent to changes as may be required by applicable law.
